Senior Partner David Kirwan is an expert in the area of Judicial Review, having acted in a number of high profile cases.
The process of Judicial Review allows the High Court to control the decisions of public bodies and the courts.
David is acting on behalf of Wirral Residents’ Alliance which is seeking to win a Judicial Review against the decision by Wirral Borough Council to close a swathe of libraries, museums and other public amenities.
He has also gained a high profile reputation for his work on behalf of British farmers involved in potentially devastating disputes with the Department for Environment, Food and Rural Affairs (DEFRA).
David won a landmark ruling by the High Court in London to examine the case of Cheshire farmer David Dobbin whose cattle faced being slaughtered on the orders of DEFRA.
Public bodies that may be challenged by Judicial Review include the Government, Courts, Local Authorities, Police Authorities, NHS Trusts, Inland Revenue, Customs and Excise, Trading Standards, Housing Associations, Universities and Charities.
Increasingly, the application of Judicial Review and Public Law is affected by the Human Rights Act 1998.
